In this empirical paper, Jay, Stone, Meksin, Merck, Gordon and Hirst examine whether jury deliberations, in which individuals collaboratively recall and discuss evidence of a trial, shape the jurors’ memories. In doing so, Jay and colleagues provide a highly ecologically valid baseline for future investigation into why, how and when selective recall either facilitates remembering or leads to forgetting during jury deliberations. Applied Christian Ethics addresses selected themes in Christian social ethics. Part one shows the roots of contributors in the realist school; part two focuses on different levels of the significance of economics for social justice; and part three deals with both existential experience and government policy in war and peace issues.

This is a collection of essays written by leading experts in honour of Christopher Rowe, and inspired by his groundbreaking work in the exegesis of Plato. The authors represent scholarly traditions which are sometimes very different in their approaches and interests, and so rarely brought into dialogue with each other. This volume, by contrast, aims to explore synergies between them. Local food systems can have economic and social benefits by providing income for producers and improving community connections. Ongoing global climate change and the acute COVID-19 pandemic crisis have shown the importance of building equity and resilience in local food systems. We interviewed ten stakeholders from organizations and institutions in a U.S. midwestern city exploring views on past, current, and future conditions to address the following two objectives: 1) Assess how local food system equity and resilience were impacted by the (...) COVID-19 pandemic, and 2) Examine how policy and behavior changes could support greater equity and resilience within urban local food systems. We used the Community Capitals Framework to organize interviewees’ responses for qualitative analyses of equity and resilience. Four types of community capital were emphasized by stakeholders: cultural and social, natural, and political capital. Participants stated that the local food system in this city is small; more weaknesses in food access, land access, and governance were described than were strengths in both pre- and post-pandemic conditions. Stakeholder responses also reflected lack of equity and resilience in the local food system, which was most pronounced for cultural and social, natural and political capitals. However, local producers’ resilience during the pandemic, which we categorized as human capital, was a notable strength. An improved future food system could incorporate changes in infrastructure (e.g., food processing), markets (e.g., values-based markets) and cultural values (e.g., valuing local food through connections between local producers and consumers). These insights could inform policy and enhance community initiatives and behavior changes to build more equitable and resilient local food systems in urban areas throughout the U.S. Midwest. This article critically questions the commercialization of hospice care and the ethical concerns associated with the industry's movement toward “market-driven medicine” at the end of life. For example, the article examines issues raised by an influx of for-profit hospice providers whose business model appears at its core to have an ethical conflict of interest between shareholders doing well and terminal patients dying well. Yet, empirical data analyzing the experience of patients across the hospice industry are limited, and general claims that (...) end-of-life patient care is inferior among for-profit providers or even that their business practices are somehow unseemly when compared to nonprofit providers cannot be substantiated. In fact, non-profit providers are not immune to potentially conflicting concerns regarding financial viability (i.e., “no margin, no mission”). Given the limitations of existing empirical data and contrasting ideological commitments of for-profit versus non-profit providers, the questions raised by this article highlight important areas for reflection and further study. Policymakers and regulators are cautioned to keep ethical concerns in the fore as an increasingly commercialized hospice industry continues to emerge as a dominant component of the U.S. health care system. Both practitioners and researchers are encouraged to expand their efforts to better understand how business practices and commercial interests may compromise the death process of the patient and patient's family — a process premised upon a philosophy and ethical tradition that earlier generations of hospice providers and proponents established as a trusted, end-of-life alternative. I HAVE to correct a mistake in my article in the last number of the C.Q., on p. 195, n. 1. The sentence containing it runs; ‘Thus, for the consular provinces of 51–50, the Senate picked out the two senior ex-consuls who had not yet held consular governorships.’ But, to begin with, it is apparent from Caesar, B.C. I. 6, 5, that Cotta, who had been consul in 65, and was therefore senior to Cicero and Bibulus, had not held a (...) consular province by 49. And secondly, as to what was done in determining who should have the consular provinces of 51–50, there seems to be no evidence. Cicero's statement in Ad Fam. III. 2, i, that praeter opinionem it had become necessary for him to go out to a province, may mean that he had counted on being unaffected by the regulations of 52, and that either a subsequent decree of the Senate or some arrangement made by a few senatorial leaders had upset his expectations. But of course praeter opinionem may refer to his not having expected before 52 that he would have to undertake a governorship. Nor can we tell whether his words, Vides ex senatus consulto provinciam esse habendam, refer to a decree prescribing who should draw lots for the consular provinces of 51–50, or merely to a decree which had the effect of obliging Appius to hand over Cilicia to a successor. However, the point that after 52 the Senate or its leaders had some power to determine what ex-magistrates should draw lots for provinces, seems to be sufficiently proved by Ad Fam. VIII. 8, 8, where praetorian provinces are concerned, and Caesar, B.C. I. 85, 9. (shrink)

This article discusses the paradox of exclusion/inclusion: U.S. health policy prohibits Latinos who fall under certain classifications from accessing health services and insurance yet permits them to be human subjects in health research. We aim to advance the discussion of health research ethics post the Tuskegee syphilis experiment in Latinos by (a) tracing the impacts of policy exclusion and the social context of anti-Latino sentiment on Latinos' low participation rates in health research and inequitable access to treatment modalities; (b) challenging (...) researchers to address social sources of vulnerabilities; and (c) offering recommendations on adapting a social justice ethical stance to address these challenges, which are part of the Tuskegee Study legacy. Near the beginning of In Toga Candida, Cicero informed his audience of a private meeting between his two most serious competitors for the consulate and the managers of their campaigning funds. This meeting took place at the house of a nobleman whom Cicero did not name but to whom he attributed a signal notoriety in the practice of electoral corruption. Asconius offers a solution without hesitation: it was at the house of either Caesar or Crassus. He explains his choice: these (...) two men were Cicero's most committed and influential opponents in his campaign for the consulate, and he has excellent evidence for their opposition: Cicero's own Expositio consiliorum suorum, no longer extant. The credibility or otherwise of this controversial work must be dismissed from any enquiry into the identity of the mysterious figure, however. Asconius, in naming the two alternative possibilities, discloses himself to be without authoritative evidence on the point. Nothing can have been said in De consiliis suis to identify the house, the meeting, or the notorious nobleman. Asconius' words reveal that his attempt at an identification is based on Cicero's assertion therein of an overt hostility to him on the part of both Crassus and Caesar during the campaign. His attribution of a covert ‘dirty tricks’ operation to one of them is no more than speculation. (shrink)

This article gives a historical-philosophical overview of three generations of pragmatist thinking centered around the question of democracy. It serves as an introduction and contextualization to the papers that develop a third generation pragmatic point of view in the remainder of the special issue. The perspective is from one American-trained philosopher of education who has studied and written widely in pragmatism and European social theory. The article has sections on three generations generally described and with primary influences of John Dewey, (...) Richard Rorty, and Bruno Latour. In each generation, other important philosophic contributions discussed come from C. S. Peirce and William James, Hilary Putnam, Donna Haraway, and Isabelle Stengers as well as relevant commentators. The first two, Dewey and Rorty, contribute to a sub-theme of democracy in their writings that the third, Latour, continues in politics in a section elaboration. The introduction sets forth a generational theme and an international setting for pragmatism. The conclusion summarizes the article's key ideas and points to a need in education for a democratic future. (shrink)

My aim in this paper is to explain how universal statements, as they occur in scientific theories, are actually tested by observational evidence, and to draw certain conclusions, on that basis, about the way in which scientific theories are tested in general. 1 But I am pursuing that aim, ambitious enough in and of itself, in the service of even more ambitious projects, and in the first place: (a) to say what is distinctive about modern science, and especially modern physical (...) science, as a human intellectual activity; and (b) to show how this distinctiveness explains the unique status of modern science in human intellectual life. So I will begin by saying a few words about that larger project. One might doubt, first, whether that project is legitimate. Although everything is different from everything else, the question “What is distinctive about X?” is not necessarily well put, because X may not be anything—that is, anything distinct. And there are indeed many philosophers, otherwise of the most diverse intellectual backgrounds and tendencies, who would deny, in various ways, that modern science is a distinct thing, or that its status is unique. It seems to me that they deny something terrifyingly obvious— a fact which confronts us far more urgently than the fact that, say, ravens are black. I will put off further remarks about this until the end of the paper, however, because the discussion of my more limited present aim will focus precisely on the ways to tell when a question is well put, and whether there is such a (distinct) thing as X. That one’s methodological problems are also the subject of one’s investigation is a sign that that investigation is philosophical, although (or because) also a threat to its coherence. Second, some points about methodology. I am not a sociologist, or even a historian, nor (unlike some recent philosophers of science) will I pretend to be.. (shrink)

Arthur Danto was quite engaged in the world, through campus activism at Columbia and as an early member of Amnesty International USA. Danto's line seems to betray a deeply felt humanism that guided his practical politics. Danto's work with Amnesty was motivated in part by a brief glimpse into France's violence during the war in Algeria. He writes about being in Paris during the 1961 October Massacre and seeing the bodies of Algerian protesters, killed by police, floating in the Seine. (...) The ethic of responsiveness, as well as the desire to be able to narrate the present as past, was something Danto carried over to his philosophy as well. Danto claims that the means of fighting are therefore limited to those that would not prevent the war itself from ending and peace from beginning again. (shrink)

Hardback, $99.00."How plausible, [Dalia Nassar and I] kept asking, is it that women published philosophy in the early modern period and then simply ceased to think and publish (...) philosophy in the nineteenth century?" remarked Kristin Gjesdal recently (interview with Richard Marshall, 3:16am [blog], https://www.3-16am.co.uk/articles/gadamer-herder-and-the-womenphilosophers-of-the-long-nineteen-cent ury?c=end-times-series). Not plausible at all—yet this is what historians of women in philosophy often seem to have assumed, judging by the remarkably small amount of scholarship on nineteenth-century women philosophers compared with those of the early modern period or the twentieth century. Eileen O'Neill, for instance, claims that it was "not a particularly friendly century for women philosophers" (1). In fact, as Gjesdal and Nassar observe, women were "significant contributors" to the "thriving intellectual cultures in German-speaking countries" at this time (1). Gjesdal and Nassar contrast Germanic countries to France and Britain in this regard, yet I would add that nineteenth-century Britain too had a vibrant print and periodical culture that created openings for women philosophers such as Harriet Martineau, Anna Jameson, Frances Power Cobbe, and many others. The broader point remains: the nineteenth century has only seemed empty of women philosophers because we have not yet investigated the women thinkers of this period or challenged the canons and narratives from which they have been excluded.Recognizing German women philosophers is particularly important because the vast majority of scholarship on the nineteenth century focuses on the German tradition. Consequently, unless we recover the work of German-speaking women, we will never change the narrative about this period. This makes the present anthology invaluable for both teaching and research. Edited by Gjesdal and Nassar, it contains new translations, nearly all by Anna Ezekiel, of texts by historical German-speaking women philosophers.Regarding teaching, many courses on post-Kantian European philosophy include no women until Beauvoir or Arendt. Such courses typically cover Fichte, Hegel, Marx, Schopenhauer, Nietzsche, Husserl, and Heidegger. The editors have clearly designed this volume to enable instructors easily to bring women into such courses, by providing extracts—of suitable lengths for teaching—from women affiliated respectively with German idealism and Romanticism (Germaine de Staël, Karoline von Günderrode, and Bettina von Arnim), Marxism (Clara Zetkin, Rosa Luxemburg), Nietzscheanism (Hedwig Dohm, Lou Salomé), and phenomenology (Edith Stein, Gerda Walther). Some of these women are already well-known as political activists, as with Luxemburg and Zetkin, or under the elastic heading of "writers," as with Staël and von Arnim. But this collection presents these women's writings in a new light, showcasing their philosophical side. In an examination of the psychological aspect of passing, this essay challenges Sandy Stone's conceptualization and subsequent request for transsexuals to forego the act. Employing an auto-ethnographical approach, this essay contends that considering the “psychic” dimensions of passing requires different, and more hopeful, articulations about transsexual bodies, such that gendered and racialized transsexual bodies are produced not simply in terms of social reading and physical embodiment, but also through psychic affirmation and disavowal.

Published within weeks of Charles Darwin's Origin of Species, Isabelle Duncan's Pre-Adamite Man (1860) is the first full-length treatment of preadamism by an evangelical. Intended as a reconciliation of Genesis and geology, Duncan's work gained immediacy when it was published shortly after the September 1859 revelations that men had walked among the mammoths. Written in the tradition of evangelical 'Christian philosophy', Pre-Adamite Man deploys innovative biblical hermeneutics and recent trends in geology to set out both a biblical preadamite theory, and (...) an unorthodox angelology. Duncan responded to contemporary secular interpretations of geology by pushing evangelical concordist strategies to new frontiers, filling out an acceptance of an ancient earth with new biblically informed catastrophist proposals and extensions of salvation history, while simultaneously retaining a firm commitment to plenary inspiration. The product is a highly readable book that operates both as an accessible treatment of geology and a theological discourse. Running through six printings between 1860 and 1866, the book was reviewed by many of the period's leading journals and created a minor controversy among evangelicals. This study both brings to life this previously neglected episode in scriptural geology, and adds to recent work on Victorian popular science writing. (shrink)

We explore the nature of forgetting in a corpus of 125,000 students learning Spanish using the Rosetta Stone® foreign-language instruction software across 48 lessons. Students are tested on a lesson after its initial study and are then retested after a variable time lag. We observe forgetting consistent with power function decay at a rate that varies across lessons but not across students. We find that lessons which are better learned initially are forgotten more slowly, a correlation which likely reflects (...) a latent cause such as the quality or difficulty of the lesson. We obtain improved predictive accuracy of the forgetting model by augmenting it with features that encode characteristics of a student's initial study of the lesson and the activities the student engaged in between the initial and delayed tests. The augmented model can predict 23.9% of the variance in an individual's score on the delayed test. We analyze which features best explain individual performance. (shrink)

In his book, Earth and Other Ethics, Christopher Stone attempts to account for the moral dimension of our lives insofar as it extends to nonhuman animals, plants, species, ecosystems, and even inanimate objects. In his effort to do this, he introduces a technical notion, the moral plane. Moral planes are defined both by the ontological commitments they make and by the governance mIes that pertain to the sorts of entities included in the plane. By introducing these planes, Stone (...) is left with a set of problems. Do the planes provide anything more objective than a set of alternative ways of looking at moral problems? How can one resolve apparent conflicts between the recommendations forthcoming from distinct planes? Why do certain entities constitute moral planes; and how do we decide which planes to “buy into?” Stone’s answers to these questions endorse aseries of concessions to moral relativism. In this paper I outline an alternative to Stone’s moral planes which, while sympathetic to his ethical concerns, comes down squarelyon the side of moral realism. (shrink)

With gratitude for our commentators’ thoughtful and generous engagement with Recognizing Wrongs, we offer in this reply a thumbnail summary of their comments and responses to some of their most important questions and criticisms. In the spirit of friendly amendment, Tom Dougherty and Johann Frick suggest that a more satisfactory version of our theory would cast tort actions as a means of enforcing wrongdoers’ moral duties of repair. We provide both legal and moral reasons for declining their invitation. Rebecca (...) class='Hi'>Stone draws a particular link between civil recourse in private law theory and the right of self-defense as recognized in criminal law and moral theory. While we share Stone’s basic inclination, we argue for a different version of the link than the one that she draws. Veronica Rodriguez-Blanco provides a critique of our model of negligence law based on action theory. In response, we explain – in a way that we hope sheds light on debates over moral luck – how it is possible for the law to define negligence such that its commission depends simultaneously on the character of the defendant’s conduct and on the consequences that result from it. Though generally sympathetic to our approach, Stephen Smith faults us for failing satisfactorily to explain important remedial dimensions of tort law. Stubbornly, we insist that we can account for these, and indeed can do so on more satisfactory terms than corrective justice theorists. Finally, Erin Kelly challenges us to consider how our work might inform the analysis of two pressing issues of racial justice: overcriminalization and reparation payments. While we question whether our work to date has as much to offer on these matters as she suggests, we also maintain that the core principle of civil recourse theory – where there is a right there is a remedy – provides grounds for critiquing modern law’s failure to provide adequate accountability when police officers use excessive force against persons of color. The goal of this essay is to illustrate how Ebrahim Moosa's method of “contrapuntal reading” can be applied fruitfully to the Sunni hadith literature. My case study is the set of penalties (hudud) for illicit sex, which include flogging, stoning, and banishment. I propose a fresh reading of these sacred texts that brings to the fore the ethical dimension of Prophet Muhammad's conduct, especially his strong reluctance to apply these measures. I conclude by identifying four ethical problems that the stoning (...) penalty raises and suggest how the hadith literature can be read to argue against the validity of this specific punishment.
